This Education Privacy Notice describes how DMTI, Inc. (“DMTI,” “we,” or “us”) collects, uses, discloses, and otherwise processes information in connection with providing our educational services to schools (the “Service”). The Service is subject to the Family Educational Rights and Privacy Act and similar state education privacy laws (collectively, “FERPA”) and the Children’s Online Privacy Protection Act (“COPPA”). DMTI is a “school official” under FERPA and receives student information on behalf of and pursuant to agreements with schools/districts. Schools, districts, and/or guardians consent to our collection, use, and disclosure of students’ information as described in this Education Privacy Notice as required by COPPA. DMTI does not (1) sell, license, or rent students’ personal information, (2) engage in, inform, influence or enable advertising to students, or (3) use students’ personal information other than to provide the Service or comply with legal obligations as described below.

 

This Education Privacy Notice does not apply to any information we process in connection with operating our direct-to-consumer educational mobile applications (such information is governed by our Children’s Privacy Notice) or operating our websites (such information is governed by our Website Privacy Notice).

 

This Education Privacy Notice is effective as of the “Last Updated” date above. We may change this Education Privacy Notice from time to time. If we make changes, we will notify you by revising the “Last Updated” date. Where required by law, we will notify you through the Website or by other means and seek your consent to or allow you to opt of the changes. We encourage you to review this Education Privacy Notice regularly to stay informed about our information practices and the choices available to you.



COLLECTION OF INFORMATION

 

Student Information

We receive student information like name, school ID, account credentials, gender, and race/ethnicity from schools. We also collect student assessment/performance data through the Services.

Teacher Information

We collect contact information like names and email addresses/account credentials from teachers.

Information We Collect Automatically

We automatically collect information when teachers and students use the Services, including access times, pages viewed, and links clicked. We also collect information about the devices used to access the Services, including unique device identifiers, hardware model, operating system version, IP address, and browser information.

 

USE OF INFORMATION

We use information for the following purposes:

  • Providing the Services: we use information to provide and maintain our Services, including to authenticate accounts and assess students’ performance and progress.

  • Research and Development: we generate de-identified or aggregated information that we use for research and development purposes, including to analyze and improve our Services.

  • Protection and Compliance: we use information to detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity, help protect the rights and property of DMTI and others, and comply with our legal and financial obligations.

 

DISCLOSURE OF INFORMATION

 

We disclose the categories of information described above as follows:

 

  • Schools: we provide students’ assessment/performance data to schools/teachers.

  • Vendors: we disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with web hosting, payment processing, fraud prevention, customer service, data enrichment, analytics, and marketing and advertising.

  • Professional Advisors: we disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

  • Legal Authorities: we may disclose information to legal authorities and others for the Protection and Compliance purposes described above, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of DMTI, our users, the public, or others.

  • Corporate Transactions: we reserve the right to disclose information in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. 

  • Affiliates: we reserve the right to disclose information between and among DMTI and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.

PRIVACY RIGHTS

 

COPPA permits guardians to request access to or deletion of children’s information and to instruct companies to stop collecting or using children’s information. Since DMTI provides the Services to students on behalf of schools, guardians should contact schools with such requests. DMTI will forward any requests it receives to the appropriate school, unless DMTI’s contract with the school or applicable law requires otherwise.
